Build A Website provides a subscription-based service including:

Services are delivered on a monthly subscription basis with a minimum commitment period, as outlined below.

2. Pricing and Billing

Billing:

Subscriptions are billed monthly in advance to the payment method provided during signup.

Minimum Commitment:

A 6-month minimum commitment is required for all subscriptions.

No Upfront Fees:

No additional setup or onboarding fees are charged.

Taxes:

Prices are exclusive of applicable taxes (e.g., US sales tax, Canadian GST/HST), which will be added based on your billing address.

Payment Processing:

Payments are processed securely via Stripe. You authorize us to charge your payment method for recurring monthly fees and applicable taxes.

Failed Payments:

If a payment fails, we will attempt to reprocess it. Failure to pay may result in suspension or termination of Services after 7 days' notice.

3. Subscription and Cancellation

Subscription Term:

Your subscription begins on the date of signup and continues monthly until canceled, subject to the 6-month minimum commitment.

Cancellation Policy:

• No cancellations are permitted during the first 6 months of the subscription.
• After 6 months, you may cancel at any time by contacting our support team at [email protected]. Cancellation takes effect at the end of the current billing cycle.
• To request cancellation, submit a written request via email.

Termination by Us:

We may terminate or suspend your subscription for non-payment, violation of these Terms, or other reasonable cause, with 7 days' written notice.

4. Refund Policy

No Refunds:

No refunds are provided for partial months, unused Services, or early termination within the 6-month minimum commitment period.

Disputes:

If you believe a charge was made in error, contact us within 30 days at [email protected] to resolve the issue.

5. Customer Responsibilities

Accurate Information:

You agree to provide accurate billing and contact information and to update it promptly if it changes.

Content:

You are responsible for providing content (e.g., text, images) for your website. All content must comply with applicable laws and not infringe on third-party rights.

Usage:

You agree not to misuse the Services (e.g., using the website for illegal activities). We reserve the right to remove non-compliant content.

6. Support

Availability:

Response Time:

We aim to respond to support inquiries within 2 hours.

7. Intellectual Property

Our Property:

We retain ownership of all templates, code, and tools used to create your website, licensed to you for use during your subscription.

Your Property:

You retain ownership of content you provide (e.g., logos, text). By providing content, you grant us a non-exclusive license to use it for delivering the Services.

8. Limitation of Liability

To the fullest extent permitted by law, Build A Website shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services, including but not limited to loss of profits or data. Our total liability shall not exceed the amount paid by you for the Services in the preceding 6 months.

9. Indemnification

You agree to indemnify and hold harmless Build A Website, its affiliates, and employees from any claims, damages, or expenses arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

10. Modifications to Services and Terms

Service Changes:

We may modify or discontinue aspects of the Services with 30 days' notice. If a change materially affects your subscription, you may contact us to discuss options.

Terms Updates:

We may update these Terms at any time. Changes will be posted on our website (buildawebsite.cc/legal/terms-of-service). Continued use of the Services after updates constitutes acceptance of the revised Terms.
